Clearlight Saunas Europe – Special Conditions for Warehouse Sale (B-stock / Second-Hand / Display Models)

(applies in addition to the General Terms and Conditions at www.clearlightinfrarotkabinen.de/legal/agb)

1. Scope & Conclusion of Contract

These special conditions apply to the sale of used, demonstrated, or B-stock products (second-hand, display models, returns, discontinued models) and come into force as an addition to our General Terms and Conditions (GTC). The contract is concluded in German in accordance with the provisions of the GTC. By purchasing a B-stock item, the customer declares to have read and accepted these special conditions.

2. All Sales Are Final

All items purchased during the warehouse sale (B-stock) are excluded from exchange and return. There is no right of withdrawal or return, except where mandatory statutory warranty rights require it. Our usual 30-day return policy for new goods does not apply.

3. Product Condition

The following items may be offered in the warehouse sale:
- Display or demonstration models
- Refurbished or returned products
- Discontinued models
- Products with purely cosmetic defects (e.g., scratches, stains, minor damage)

Each item is sold in its current condition ("as seen") and is priced accordingly. Known defects or deficiencies (cosmetic or functional) will be disclosed before purchase. Product details and condition will be clearly described at the time of sale. Buyers will receive a description and/or photos of the sauna's condition, including all known defects, before purchase. By purchasing, the customer confirms having inspected and accepted the product's condition. Further claims regarding known or disclosed defects are excluded.

4. Warranty & Guarantee

For B-stock items, a modified, limited warranty applies, which differs from our standard warranty for new goods:
- The scope of the warranty is specified individually for each item.
- In most cases, the warranty is 5 years (compared to our lifetime warranty for private customers or extended warranty).
- The warranty applies exclusively to structural and functional components.
- Known or disclosed cosmetic defects (e.g., dents, scratches, stains) are excluded from the warranty.

Further price reductions, credits, or warranty claims in connection with disclosed defects are excluded. All statutory warranty rights remain unaffected.

5. Availability & Allocation

The offer is strictly limited and operates on a "first come, first served" basis. We reserve the right to limit the quantity per customer. Reservation or pre-holding of items is not possible.

6. Prices

All prices are final and reflect the reduced warehouse sale prices. Additional discount codes, promotions, or special offers do not apply unless explicitly stated.

7. Payment

The sale operates on the principle of "first paid, first served." A mere expression of interest, inquiry, or order without full payment does not constitute a reservation or guarantee of availability. The seller reserves the right to allocate the item to the customer whose full payment is received first – regardless of the order of inquiries or offers.

Full payment is due at the time of purchase. Accepted payment methods: credit card, bank transfer, or other approved payment methods.

8. Delivery, Shipping & Collection

- Delivery: Standard delivery and installation in metropolitan areas are included in the price.
- For deliveries outside our standard areas, we will provide an individual quote.
- Delivery time is usually 3-7 business days within Germany after receipt of payment (deviating delivery times will be communicated).
- Partial deliveries are possible if this is advantageous for prompt processing.

Collection: Alternatively, collection can be made directly from our warehouse by prior appointment.

9. Transit Damage & Complaints

- Visible transit damage must be documented immediately upon delivery and confirmed with the carrier.
- Concealed damage must be reported to us in writing immediately upon discovery, but no later than 5 business days.
- The original packaging must be kept until the matter is fully resolved.

10. Liability

Clearlight Saunas is not liable for indirect or consequential damages arising from the use of discounted warehouse sale items. The customer is responsible for ensuring that sufficient space, a level surface, a suitable power connection, and adequate ventilation are available before installation. Liability for intent and gross negligence remains unaffected.

11. Changes & Cancellations

We reserve the right to cancel or modify an offer or sale if an error is found or the item is no longer available. In the event of cancellation by us, a full refund will be issued.

12. Confirmation of Condition

By completing the purchase, the customer confirms:
- Having checked the condition of the sauna based on the description and/or photos.
- Accepting all known or disclosed defects.
- Having read and accepted the sales conditions and the adjusted warranty.

Further claims regarding previously disclosed defects are excluded.
