Clearlight Saunas Europe – Special Terms for Warehouse Sale (B-Stock / Second-Hand / Display Items)

(Applies in addition to the General Terms and Conditions at www.clearlightinfrarotkabinen.de/legal/agb)

1. Scope & Conclusion of Contract

These special terms apply to the sale of used, demo, or B-stock products (second-hand, display units, returns, discontinued models) and supplement our General Terms and Conditions (GTC). The contract is concluded in German in accordance with the GTC. By purchasing a B-stock item, the customer confirms they have read and accepted these special terms.

2. All Sales Are Final

All items purchased as part of the warehouse sale (B-stock) are excluded from exchange or return. There is no right of withdrawal or return, except where mandatory statutory warranty rights apply. Our standard 30-day return policy for new products does not apply.

3. Product Condition

The following types of items may be offered in the warehouse sale:

• Each item is sold in its current condition ("as seen") and priced accordingly. Known defects or flaws (cosmetic or functional) are disclosed before purchase.
• Product details and condition are clearly described at the time of sale. Buyers will receive a description and/or photos of the sauna’s condition, including all known defects.
• By purchasing, the customer confirms they have reviewed and accepted the item’s condition. Further claims regarding disclosed or known defects are excluded.

4. Warranty & Guarantee

B-stock items are covered by a limited, adjusted warranty that differs from our standard warranty for new items:

• 5 years (in contrast to our lifetime warranty for private customers or extended warranties).
• only to structural and functional components.
• excluded from warranty coverage.
• No further discounts, credits, or warranty claims are available regarding disclosed defects. All statutory warranty rights remain unaffected.

5. Availability & Allocation

The offer is strictly limited and follows a "first come, first served" policy. We reserve the right to limit the quantity per customer. Reservation or pre-holding of items is not possible.

6. Pricing

All prices are final and reflect reduced warehouse sale pricing. Additional discount codes, promotions, or special offers do not apply unless explicitly stated.

7. Payment

Sales are based on the "first to pay, first to receive" principle. Expressing interest, inquiring, or placing an order without full payment does not constitute a reservation or guarantee of availability. The seller reserves the right to allocate the item to the first customer whose full payment is received — regardless of inquiry or offer order.

Full payment is due at the time of purchase.
Accepted payment methods: credit card, bank transfer, or other approved methods.

8. Delivery, Shipping & Pickup

Standard delivery and installation in metropolitan areas are included in the price.
3–7 working days within Germany after receipt of payment (different delivery times will be communicated).
Pickup: Alternatively, items may be picked up directly from our warehouse by prior appointment.

9. Transport Damage & Complaints

Any Damage or Complaints must:

• be documented immediately upon delivery and confirmed by the carrier
• be reported promptly upon discovery, but no later than 5 working days after delivery, in writing.
• Item's original packaging must be retained until the issue is fully resolved.

10. Liability

Clearlight Saunas is not liable for indirect or consequential damages arising from the use of discounted warehouse sale items.

It is the customer’s responsibility to ensure sufficient space, a level surface, suitable power supply, and adequate ventilation prior to installation.

Liability for intent and gross negligence remains unaffected.

11. Changes & Cancellations

We reserve the right to cancel or amend an offer or sale if an error is found or the item is no longer available. In the event of cancellation by us, a full refund will be issued.

12. Confirmation of Condition

By completing the purchase, the customer confirms:

• Having inspected the sauna's condition based on the description and/or photos.
• Accepting all known or disclosed defects.
• Having read and accepted the terms and conditions of sale and the adjusted warranty.
• Further claims relating to previously disclosed defects are excluded.
